Unless otherwise stipulated in this Code, all actions to which its application gives rise shall be heard in summary proceeding, unless the parties have agreed to submit their differences to arbitration.

In proceedings of indeterminate value and in those whose amount exceeds two thousand quetzales (Q2,000.00), the cassation appeal shall be available, under the terms established in the Code of Civil and Commercial Procedure.

In mercantile matters, executory instruments are: certified copies of the record of protocolization of protests of mercantile and banking documents, or the documents themselves if the protest is not legally required.
