If, due to the particularities of the case, any of the parties considers it necessary to be assisted by a consultant in a science, art or technique, it shall propose the consultant to the Public Prosecutor's Office or to the tribunal, which shall decide on his or her appointment, pursuant to the rules applicable to experts, as pertinent, unless he or she is legally disqualified under this Code.

The technical consultant may be present at the expert operations and make observations during the course thereof, but shall not issue an opinion; the experts shall record the observations. In the debates, he or she may accompany the person whom he or she assists, directly question the experts, translators or interpreters, and conclude on the expert evidence, always under the direction of the party who proposed him or her.
