Capítulo V. Reparaciones

Reparation to the victim shall be proportional to the harm caused and to the degree of culpability of the perpetrator of the crime. In no case shall it imply unjust enrichment of the victim.

Compensation may be decreed by the justice bodies hearing the specific case.

When the victim has died, the right to reparation extends to their successors, in accordance with the provisions of the Civil Code and the Code of Criminal Procedure.

In compliance with what is established in the Political Constitution of the Republic regarding human rights accepted and ratified by the State of Guatemala, the State shall be jointly and severally liable for the act or omission incurred by female or male public officials who obstruct, delay or deny compliance with the sanctions provided for in the present law, and may exercise against them the action of repetition if it is held liable, without prejudice to administrative or civil liabilities.
