Article 190 Res Judicata

The decisions issued in constitutional relief (amparo) and habeas corpus (exhibición personal) proceedings are of declaratory effect and do not give rise to a res judicata defense, without prejudice to the provisions relating to jurisprudence in matters of constitutional relief (amparo).

The decisions in cases involving a challenge of unconstitutionality of laws, regulations and provisions of a general nature only have res judicata effect with respect to the specific case in which they were issued, but they also have jurisprudential effects.

Article 191 Supplementary Application Provisions

For situations not provided for in the present law, the regulatory provisions that the Constitutional Court shall promulgate and publish in the Official Gazette shall apply.

Article 192 Amendments to the Law

This Law may be amended by the Congress of the Republic and its amendment requires the vote of two-thirds of the deputies comprising the Congress, upon prior favorable opinion of the Constitutional Court.

Article 194 Repeal

Decree number 8 of the National Constituent Assembly of the Republic of Guatemala of April 20, nineteen hundred sixty-six, and any other provision that is contrary to or opposes this law, are hereby repealed.

Proceedings initiated under the authority of the repealed law shall immediately conform to the procedures of the new law upon its entry into force. The tribunals may grant the interested parties the necessary period to comply with requirements that the same tribunal deems to be missing. However, until the Constitutional Court is constituted, matters relating to the appeal shall be processed in accordance with the provisions of the above-cited Decree.

Article 195 Entry into Force of This Law

The present law shall enter into force on the fourteenth day of January, nineteen hundred eighty-six.
