Article 68 Applicable Rules

Except as specially provided in this Title, the rules on trademarks contained in this Law and, particularly, those relating to procedures, validity, modification, renewal and extinguishment of the registration are applicable to commercial advertising expressions or signs.

Article 69 Prohibitions

An advertising expression or signal may not be registered if the whole thereof or any of its elements falls within the following cases:

a)They are covered by any of the prohibitions contained in Article 20 of this Law;

b)It is identical or similar to another that was already registered or applied for registration by a third party;

c)It includes a distinctive sign belonging to another, or one similar thereto, without due authorization;

d)It is liable to cause confusion with respect to the products, services, enterprise or establishment of a third party; and

e)They are covered by any of the prohibitions detailed in subparagraphs c), d), e), f), g) and h) of Article 21 of this Law.

Article 70 Scope of Protection

The protection conferred by the registration of a commercial advertising expression or sign covers the expression or sign as a whole, and does not extend to its parts or elements considered separately.
