Libro Segundo · Título II Capítulo I. Disposiciones generales

Ownership is the right to enjoy and dispose of property within the limits and with observance of the obligations established by the laws.

The owner, in the exercise of his right, may not perform acts that cause harm to other persons and, especially in his industrial exploitation works, is obligated to refrain from any excess harmful to the neighbor's property.

Whoever suffers or is threatened with harm because another exceeds or abuses in the exercise of his ownership right may demand that the prior state be restored, or that appropriate measures be adopted, without prejudice to compensation for the harm suffered.

Property may be expropriated for reasons of collective utility, social benefit or public interest, upon prior compensation determined in accordance with the law on the matter.

The owner has the right to defend his property by legal means and not to be disturbed therein, if he has not previously been summoned, heard and defeated in trial.

The owner of a thing has the right to recover it from any possessor or detainer. 64 65 66 67

The product or value of lawful work or industry, as well as the productions of the ingenuity or talent of any person, are their property and are governed by the laws relating to property in general and by the special laws on these matters.

The owner of a property has the right to its fruits and to whatever is incorporated by accession, in accordance with the provisions of the respective chapter of this Code.

Things of private property, immovable and movable, declared as objects of artistic, historic or archaeological interest, are subject to special laws.
