Libro Segundo Título IX. De los delitos de falsedad personal

Whoever, without title or legitimate cause, performs acts proper to an authority or public official, claiming official status, shall be sanctioned with imprisonment of one to three years.

Whoever arrogates to himself an academic title or performs acts pertaining to professionals, without holding a title or special authorization, shall be sanctioned with imprisonment of five to eight years, and a fine of fifty thousand to two hundred thousand quetzales.

If harm to a third party results from the illegal practice, the sanction set forth in the preceding paragraph shall be increased by one-third.

Whoever publicly uses a fictitious name shall be sanctioned with a fine of five hundred to three thousand quetzales.

If the use of the fictitious name is intended to conceal a crime, evade a sentence, or cause harm to the State or to a private individual, in addition to the sanction indicated in the preceding paragraph, imprisonment for one to two years shall be imposed on the person responsible.

Whoever uses as their own another person's passport or legitimate identity document shall be sanctioned with imprisonment of one to three years.

The same sanction shall apply to whoever transfers to another, for that other to use it, their own passport or legitimate identity document.

The sanction shall be increased by half when the illegitimate use of the identity document is for electoral purposes.

If the crime is committed by a public official or employee of the Supreme Electoral Tribunal, member of a Departmental Electoral Board, Municipal Electoral Board, Vote Receiving Board, public official or employee of the State of any of its bodies or autonomous, decentralized and non-governmental institutions, regardless of their form of election or type of legal employment relationship, in addition to the penalty, disqualification from the exercise of the public employment or office they hold shall be applied to them.

Whoever publicly and improperly uses the dress or uniform of an institution to which they do not belong, or insignia or decorations that they are not authorized to wear, shall be sanctioned with a fine of one hundred to five hundred quetzales.
