Article 70 General Principles
Any service or work that is not required to be performed gratuitously by virtue of law or judgment must be equitably remunerated.
Public servants covered by the Competitive Examination Services and Non-Competitive Examination Services must be remunerated on the basis of a system that guarantees the principle of equal wage for equal work, performed under equality of conditions, efficiency and seniority.
Article 71 Wages Plan
In consultation with the Ministry of Public Finance and with the respective appointing authorities, the Director of the National Civil Service Office shall prepare and submit for the consideration of the President of the Republic a wages plan for the employees and public officials covered under the Competitive Services and Non-Competitive Services, for which the Director shall formulate a scale for each class of positions, which shall comprise minimum and maximum remunerations, and such intermediate remunerations as are deemed appropriate.
For compliance with this provision, the Director must take into consideration the requirements of the classes of positions established in the Classification Plan, the prevailing wage levels in the autonomous, semi-autonomous and decentralized entities, and in private enterprises; the possibilities of the administration and all other pertinent conditions and circumstances.
The Director must review the wages plan at least every four years to determine whether it warrants any type of modification.
Article 72 Period in Force of the Plan
The President of the Republic, through the respective ministry, shall submit to the Legislative Branch the corresponding bill, which, once approved and promulgated, shall constitute the Wage Law for all classes of positions in the Competitive Examination Services and the Non-Competitive Examination Services.
The rules of the wage plan shall be applied by the fiscal authorities for the payment of wages, accounting and budgetary control, and the other consequent effects.
Article 73 Evaluation
Every nominating authority, under its responsibility, in accordance with the respective regulation, and through each of the heads of departments, must evaluate at least once a year all public servants under its supervision. This evaluation shall serve as a basis for recommending promotions, training and salary increases, in accordance with the corresponding scale and with the possibilities of the State.
