Título III

For purposes of the application of this law and its regulations, positions in the State service are comprised in the following types of services:

1.Exempt Service;

2.Service without Competitive Examination;

3.Service by Competitive Examination.

The Exempt Service is not subject to the provisions of this law and comprises the positions of:

1.Public officials appointed by the President upon proposal of the Council of State;

2.Ministers and Vice Ministers of State, Secretaries, Undersecretaries and Counselors of the Presidency of the Republic, Directors General and Departmental Governors;

3.Public officials and employees in the Diplomatic Career, in accordance with the Organic Law of the Diplomatic Service of Guatemala;

4.Treasurer General of the Nation;

5.Government Notary;

6.Manager of the National Lottery;

7.Public officials of the Council of State;

8.Registrars of Property and corresponding personnel;

9.Inspector General of Labor;

10.Public officials of the Presidency of the Republic who depend directly on the President;

11.Members of the security corps;

12.Persons who are hired to provide interim, occasional services, or for a limited time under special contract;

13.Employees of the Secretariat of the Presidency of the Republic;

14.No more than ten public officials or public servants in each Ministry of State, whose functions are classified as of trust by the corresponding heads;

15.Persons who hold ad honorem positions.

The Service without Opposition comprises the positions of:

1.Technical advisors;

2.Legal advisors;

3.Hospital directors.

The members of this service are subject to all the provisions of this law, except those referring to appointment and dismissal.

The Service by Opposition includes the positions not covered under the Exempt and Without Opposition services that appear specifically in the Position Classification System of the Service by Opposition established by this Law.
