Article 106

Notaries, as well as persons who request their professional services, are free to contract regarding fees and payment conditions. In the absence of an agreement, fees shall be regulated in accordance with this Fee Schedule, in national currency.

Article 107Amended

If the Notary requests assessment of fees, the judge shall order the Secretariat to report to him whether it conforms to the Fee Schedule; thereafter, he shall give the interested parties a two-day hearing and, if the assessment conforms to the law, he shall approve it without further proceedings. The order approving it shall be appealable and, upon becoming final, shall give rise to the enforceable title which may be enforced within the same proceedings in the Vía de Apremio or in a separate file, by means of certification of the order.

Article 108Amended

Notaries who provide their services outside their office but within the radius of the town in which they reside, in addition to the fees to which they are entitled under this tariff, shall charge fifty quetzales (Q. 50.00) for each hour of work, but if the service takes place outside the town, the Notary shall also charge six quetzales (Q. 6.00) for each kilometer or fraction thereof, added for the outward and return journey.

Article 109Amended

.- Notaries shall charge as fees:

1.. For authorization of deeds of undetermined value, from two hundred to five thousand quetzales (Q. 200.00 to Q. 5,000.00), according to their importance.

2.For deeds of determined value, in accordance with the following bases and percentages, as applicable:

a)When the value does not exceed five thousand quetzales (Q. 5000.00), three hundred (Q. 300.00) base, plus ten percent on the value of the contract.

b)From five thousand quetzales one cent (Q. 5000.01) to twenty-five thousand quetzales (Q.25,000.00), four hundred quetzales (Q. 400.00) base, plus eight percent on the value of the contract.

c)From twenty-five thousand quetzales one cent (Q. 25,000.01), to fifty thousand quetzales (Q. 50,000.00), four hundred fifty quetzales (Q. 450.00) base plus six percent on the value of the contract.

d)From fifty thousand quetzales one cent (Q. 50,000.01) to one hundred thousand quetzales (Q. 100,000.00), five hundred quetzales (Q. 500.00) base, plus four percent on the value of the contract.

e)From one hundred thousand quetzales one cent (Q. 100,000.01) to one million quetzales, (Q.1,000,000.00), five hundred quetzales (Q. 500.00) base, plus three percent on the value of the contract.

f)From one million quetzales one cent (Q. 1.000.000.01) onward, five hundred quetzales (Q. 500.00) base, plus two percent on the value of the contract.

3.For cancelled deeds, Notaries shall charge half of the fees that would have corresponded to them if they had been authorized. The grantor or grantors representing the same interest and having given rise to the cancellation shall be obliged to make the payment.

4.For authorization of company deeds, the notary shall charge in accordance with the importance of the corporate contract or on the amount of the authorized capital, whichever is more favorable to him.

5.For authorization of a will or donation upon death, he shall charge in accordance with subparagraphs 1st and 2nd of this article, as applicable.

6.. For authorization of a certified copy, fifty quetzales (Q. 50.00), when it is from the protocol of the same year in which it is requested and seventy-five quetzales (Q. 75.00) for those of prior years. For certified copies issued by the Director of the General Archive of Protocols, seventy-five quetzales (Q. 75.00)

7.. For a notarial record from one hundred quetzales (Q.100.00) to two thousand quetzales (Q. 2,000.00), according to its importance.

8.For protocolization of documents, in accordance with what corresponds according to whether their value is determined or not.

9.. For inventories, charge shall be made in accordance with the following base and percentages:

a)When it does not exceed five thousand quetzales one cent (Q. 5,000.01), one hundred quetzales base (Q. 100.00) plus ten percent on the inventoried assets.

b)From five thousand quetzales one cent (Q. 5,001.01) to twenty-five thousand quetzales (Q. 25,000.00) one hundred quetzales base (Q. 100.00) plus eight percent on the inventoried assets.

c)From twenty-five thousand quetzales one cent (Q. 25,000.01) to fifty thousand quetzales, (Q. 50,000.00) one hundred quetzales base (Q. 100.00) plus six percent on the inventoried assets.

d)From fifty thousand quetzales one cent (Q. 50,000.01) to one hundred thousand quetzales (Q. 100,000.00) one hundred quetzales base (Q. 100.00) plus four percent on the inventoried assets.

e)From one hundred thousand quetzales one cent (Q. 100,000.01) to one million quetzales (Q. 1,000,000.00) one hundred quetzales base (Q. 100.00) plus three percent on the inventoried assets.

f)From one million quetzales one cent (Q. 1,000,000.01) onward, one hundred quetzales base (Q. 100.00) plus two percent on inventoried assets.

10.. For authentications, from fifty quetzales (Q. 50.00) to two hundred quetzales (Q. 200.00), according to their importance.

11.. For examination of books in any kind of public register, fifty quetzales (Q. 50.00), the first book and twenty-five quetzales (Q. 25.00) for each of the subsequent ones.

12.. For verifying transfer operations in fiscal, municipal or register offices, fifty quetzales (Q. 50.00) for each verification.

13.For drafting a private document or preparing a draft, Notaries shall charge half of the fees that would correspond to them in accordance with subparagraphs 1st and 2nd of this article, but if the draft is incorporated into a public instrument by the Notary himself, he shall charge only the fees fixed in said subparagraphs, as applicable.

14.. For partition projects, three hundred quetzales (Q. 300.00) base plus six percent (6%) on the divisible value up to twenty thousand quetzales (Q. 20,000.00) plus three percent (3%) on the excess.

15.. For consultations related to acts or contracts made to them, notaries shall charge from one hundred to one thousand quetzales (Q. 100.00 to 1,000), according to the importance of the matter, its amount and extent or difficulty of the consultation.

16.. In addition to the fees specified above, the Notary shall charge for writing at the rate of five quetzales (Q. 5.00) for each page or fraction. The taxes, fiscal stamps and fees charged by the respective registers shall be for the account of the interested party.
