Título Decimosexto

The Liability Recourse against the judges and magistrates of Labor and Social Welfare shall lie:

a)When they delay without sufficient cause the administration of justice;

b)When they fail to comply with the established procedures;

c)When through negligence, ignorance or bad faith, they cause harm to the litigants;

d)When, being obliged to state the grounds for their pronouncements, they fail to do so or do so deficiently;

e)When they fail to fulfill the administrative obligations of their office; and

f)When they exhibit notorious misconduct in their public or private relations.

All of the foregoing without prejudice to liabilities of another kind that they may incur.

The Supreme Court of Justice must proceed, upon a complaint or accusation received, to investigate and examine, through one of its members or through a commissioned Magistrate of the Labor Court of Appeals, the respective case, hearing the Judge or Magistrate concerned and, if it finds the accusation or complaint to be well-founded, it must impose on the responsible public official some of the following sanctions:

a)Private admonition;

b)Public admonition;

c)Fine of one thousand five hundred (Q.1,500.00) to two thousand five hundred (Q.2,500.00) quetzales as a disciplinary correction; and,

d)In serious cases, the Supreme Court of Justice must decide on the dismissal or removal of the responsible Judge or request what is pertinent from the Congress of the Republic, if it involves Magistrates.

Against the decision in which one of the established sanctions is imposed, a motion for reconsideration lies before the Supreme Court of Justice itself, which without any proceedings shall decide outright within the term of ten days.
