Título II · Capítulo II Sección Primera. Familia

The State guarantees the social, economic and legal protection of the family. It shall promote its organization on the legal basis of marriage, the equality of rights of the spouses, responsible parenthood and the right of persons to freely decide the number and spacing of their children.

The State recognizes de facto union and the law shall prescribe all matters relating thereto.

Marriage may be authorized by mayors, council members, practicing notaries and ministers of worship empowered by the corresponding administrative authority.

All children are equal before the law and have the same rights. All discrimination is punishable.

The State shall protect the physical, mental and moral health of minors and of the elderly. It shall guarantee their right to food, health, education, and security and social welfare.

Maternity has the protection of the State, which shall especially ensure strict compliance with the rights and obligations derived therefrom.

The State guarantees the protection of disabled persons and persons who suffer from physical, mental or sensory limitations. Their medico-social care is declared of national interest, as well as the promotion of policies and services that enable their rehabilitation and their full reintegration into society. The law shall regulate this matter and shall create the technical and implementing bodies that are necessary.

The State recognizes and protects adoption. The adopted person acquires the status of child of the adopter. The protection of orphan children and abandoned children is declared of national interest.

Refusal to provide maintenance in the manner prescribed by law is punishable.

Actions against alcoholism, drug addiction and other causes of family disintegration are declared of social interest. The State shall take appropriate prevention, treatment and rehabilitation measures to make such actions effective, for the well-being of the individual, the family and society.
