Every person has the right to participate freely in the cultural and artistic life of the community, as well as to benefit from the scientific and technological progress of the Nation.

The right of persons and of communities to their cultural identity in accordance with their values, their language and their customs is recognized.

It is a primordial obligation of the State to protect, foster and disseminate the national culture; to issue the laws and provisions tending to its enrichment, restoration, preservation and recovery; to promote and regulate its scientific research, as well as the creation and application of appropriate technology.

The paleontological, archaeological, historical and artistic property and values of the country form the cultural heritage of the Nation and are under the protection of the State. Their alienation, export or alteration is prohibited, except in the cases determined by law.

Archaeological sites, monumental complexes and the Cultural Center of Guatemala shall receive special attention from the State, for the purpose of preserving their characteristics and safeguarding their historical value and cultural property. Tikal National Park, the Quiriguá Archaeological Park and the city of Antigua Guatemala, having been declared World Heritage, as well as those that acquire similar recognition, shall be subject to a special conservation regime.

National artistic expression, popular art, folklore and native handicrafts and industries shall be subject to special protection by the State, in order to preserve their authenticity. The State shall promote the opening of national and international markets for the free commercialization of the work of artists and artisans, promoting their production and adequate technification.

The State guarantees free creative expression, supports and encourages the national scientist, intellectual and artist, promoting their professional and economic training and advancement.

The conservation, protection and improvement of the Nation's natural heritage are declared of national interest. The State shall promote the creation of national parks, reserves and natural refuges, which are inalienable. A law shall guarantee their protection and that of the fauna and flora existing therein.

The activity of the State regarding the preservation and promotion of culture and its manifestations shall be in charge of a specific organ with its own budget.
