Título V. Aplicación de las sanciones para la trata de personas

Those convicted of the crimes of trafficking in persons are obligated to compensate victims for the damage and losses caused, including all care costs necessary for their complete physical, psychological and economic recovery, even if the victim had not filed a private accusation or had not expressly claimed compensation, or had abandoned the private accusation. Such items shall be determined in the convicting judgment.

Compensation shall correspond to the heirs if the victim had died.

In requests for the advance taking of evidence for the crimes covered in this Law, the judge shall weigh the best interests and the rights of the victim when stating the grounds for his or her decision.

For the purposes of investigation and criminal prosecution of the crime of trafficking in persons, the provisions on the crimes of organized crime, special aggravating circumstances, means, special methods of investigation and criminal prosecution, precautionary measures, such as the rules on collaborators and means of challenge contained in the Law against Organized Crime, Decree Number 21-2006 of the Congress of the Republic, shall apply.

For purposes of extradition of a person who commits the crime of trafficking in persons contemplated in this Law, whether active or passive, the provisions of the specific Law shall govern.
