The constitutional relief (amparo) tribunals may order the dismissal of proceedings of the case files in the event of the death of the petitioner if the affected right concerns only that person.

In case of withdrawal, if it is submitted in authentic form or is ratified before the competent authority, it shall be approved without further proceedings and the file shall be archived.

If requested, the tribunal shall rule on costs. If grounds for sanctions have arisen, the tribunal shall apply them.

No constitutional relief (amparo) file shall be archived without it being of record that what was decided has been executed and that the sanctions imposed have been satisfied in full.

Cause liability:

a)The denial of admission of a constitutional relief (amparo) or malicious delay in its processing. Delay is presumed malicious, but admits evidence to the contrary;

b)Unjustified delay in the transmission and delivery of messages and dispatches;

c)Alteration or falsity in the reports to be rendered by any person;

d)Omission of the sanctions established by this law and of the prosecution of the persons responsible;

e)Filing away a case file without it being fully concluded; and

f)Delay in notifications, which shall be sanctioned with a fine of ten to twenty-five quetzales for each day of delay.

Disobedience, delay or opposition to a decision issued in constitutional relief (amparo) proceedings by a public official or employee of the State and its decentralized and autonomous institutions is legal cause for dismissal, in addition to the other sanctions established in the laws.

Any person not a party to constitutional relief (amparo) proceedings who in any manner, by act or omission, delays, prevents, or obstructs its processing or enforcement shall be criminally liable in accordance with the law.

In cases where the State or any of its entities has paid due to the liability of the public official or subordinate, the Public Prosecutor's Office is obligated to initiate actions to recover against the person liable.

The tribunals of constitutional relief (amparo) shall remit to the Constitutional Court a certified copy of every final decision of constitutional relief (amparo), for its ordering and filing.
