Título VI. Via Pública

The public roadway shall be used solely and exclusively for the transit and circulation of persons and vehicles, whose rights shall be exercised in accordance with the provisions of this law and its regulations.

The following is strictly prohibited:

a.Obstructing, closing or restricting, temporarily or permanently, the public roadway, to the detriment of the circulation of persons and vehicles, except with prior and express authorization from the authority;

b.Placing or maintaining on the public roadway signs, markings or elements that limit or alter traffic signs;

c.Altering, destroying, damaging or removing traffic signs; and

d.Placing on traffic signs advertisements or propaganda of any kind; except with express authorization from the corresponding authority.

The transit authority is empowered to remove from the public roadway any thing, vehicle, material, advertising or other item that obstructs the circulation of persons and vehicles and to transfer it and deposit it, at the owner's expense, in the premises enabled for such purpose.

When public or private entities need to carry out their own works on the public roadway, they shall obtain a permit from the respective authority, but in any case they are obligated to indicate the work area by means of visible and adequately placed signs to prevent injuries to persons and damage to vehicles; and once the work is concluded, they are obligated to restore the public roadway, at least, to its prior condition.

The expressly appointed person in charge or, failing that, the head of the department, highest authority or legal representative of the party carrying out the works shall be directly and personally liable for the injuries and damage that such works or jobs cause to persons and vehicles traveling on the public roadway.

The parking of vehicles on public roads shall be carried out in accordance with the provisions of the corresponding traffic authority.

The construction and putting into operation of underground or elevated parking facilities on streets, parks or other national or municipal property for common use is authorized.

If said public premises lack registration in the General Property Register, under the oath of the respective public official, they shall be registered in said Register by means of a public deed and on the basis of a plan authorized by a licensed engineer, in favor of the Nation or the Municipality, as applicable.

The signals, signs and traffic lights for regulating traffic shall be established respecting international treaties and conventions.
