Libro II Título III. Medios de transporte

Upon entry and exit, every international means of transportation, air, maritime or land, shall be subject to migration control supervisions over its passengers, its crew members or its personnel. The Guatemalan Migration Institute determines at which places supervision is carried out. The entry of passengers, crew members or personnel is subject to compliance with the documentation provided for in national legislation.

The employees of the Guatemalan Migration Institute shall determine the need to provide assistance and protection to persons who require medical attention or any other emergency service in supervision procedures.

Private entities or private transport entities, whether maritime, air or land, must collaborate in controlling compliance with the documents of passengers and their personnel. For such purpose, the corresponding provisions shall be issued.

Aircraft, vessels and land vehicles may not leave the country without their passengers, crew members and personnel completing the migration control procedure. For non-compliance with this regulation, the offender shall be punished with a fine equivalent to ten thousand United States of America Dollars (US$10,000.00).

The owner, captain, commander, manager or person in charge of any means of international transport, and the companies, enterprises or agencies that own, represent, operate or act as consignees of means of international transport, are jointly and severally liable for the transportation, care and custody of passengers, crew members and personnel, until they are admitted into the country, under the conditions determined by this Code, its regulations and other migratory provisions.

In addition to the corresponding transfer, the companies, enterprises or agencies that are owners, representatives, operators or consignees of means of international transport, indistinctly, must defray any pecuniary obligation arising by reason of the rejection ordered by competent authority of passengers or crew members who do not meet the entry and stay requirements established in this Code and its regulations. Including the expenses that must be covered when such foreign persons must remain in the country for the time strictly necessary to execute the rejection.

Non-compliance with this provision shall be sanctioned with a fine equivalent to ten thousand Dollars of the United States of America (US$10,000.00).

Within border, port, and airport facilities, there shall be migration posts, through which migration supervision shall be carried out.

The Guatemalan Migration Institute shall regulate the obligations and other provisions that must be complied with for the documentation and migratory supervision of the workers of international means of transport.

The Port Captaincy, the General Directorate of Civil Aeronautics and the General Directorate of Transportation shall not authorize the entry and departure of ships, vessels, aircraft and land vehicles to and from the national territory if they do not comply with the provisions on the delivery of lists of passengers, personnel and crew members.

Passengers in transit are considered tourists or travelers.
